Las Vegas Metropolitan Police Department Foundation Volunteer Release and Waiver

This Volunteer Release and Waiver (this “Release”) releases the Las Vegas Metropolitan Police Department Foundation (the “Foundation”) from liability in connection with the provision of volunteer services. I, _________________, (the “Volunteer”) desire to provide volunteer services and participate in volunteer activities for and on behalf of the Foundation. By signing below, I (or the Volunteer’s parent or legal guardian, on Volunteer’s behalf), acknowledge that I understand and agree to the following standards, terms and conditions:

 

Volunteer Status – I understand that the scope of my relationship with the Foundation is limited to a volunteer position and that I am not entitled to, and will receive no, compensation or benefits for my Volunteer Services. I understand that I am not an employee or independent contractor of the Foundation.

 

•       I will not commit acts contrary to the highest standards of ethical conduct, and I will promptly report the commission of such acts to the Volunteer Relations Coordinator or another Foundation representative, as may be necessary.

•       I will at all times: (a) perform my volunteer activities in accordance with relevant laws, regulations and Foundation policies and standards; (b) promote the attainment of the Foundation's legitimate and ethical objectives; and (c) represent the interests of all constituencies served by the Foundation and not favor special interests inside or outside the Foundation in connection with Foundation business.

•       I will refrain from engaging in or supporting any activity that would reflect poorly on the Foundation.

•       I will disclose, at the time I execute this document and thereafter, as the same may arise, any official investigations of criminal activities, arrests and/or convictions involving me (other than for routine traffic offenses not involving drugs or alcohol). Depending on the nature of my volunteer activities, I understand that I may be required to submit to a criminal background check, at my own cost and expense, prior to starting my volunteer activities with the Foundation and from time to time, in the Foundation’s discretion, after beginning my volunteer activities.

•       I will only wear or otherwise use the LVMPD Foundation navy blue t-shirt that was provided to me during events held by the Foundation and at no other time, unless expressly authorized by the Volunteer Coordinator or another Foundation representative. At the end of my term as a volunteer with the Foundation, I will return the LVMPD Foundation navy blue t-shirt to the Volunteer Relations Coordinator or another Foundation representative.

 

Conflicts of Interest

•       I will either avoid, or will promptly disclose and recuse myself from, any decisions involving any activity or practice those conflicts with, or can be perceived as conflicting with, the interests of the Foundation, including, but not limited to, situations where I, or a relative, friend or business acquaintance of mine, proposes to provide goods or services to the Foundation for consideration.

•       I will refrain from using Foundation property or resources for personal profit or advantage, or for any purpose not related to the activities of the Foundation.

•       I will refuse any personal gifts, loans, favors, or other consideration of more than nominal value from any Foundation vendor, sponsor, or other outside party that would influence, or could be perceived as influencing, my actions or the actions of others.

 

Confidentiality

•       During my involvement as a Volunteer with the Foundation and thereafter, I will maintain the confidentiality of any and all information regarding the Foundation, children and their families, donors and volunteers, in whatever form produced, prepared, observed or received, unless legally obligated to do otherwise.

•       I will not use, or appear to use, confidential information acquired during the course of my service for unethical or illegal advantage, either personally or through third parties.

 

Release of Liability

•       I understand and agree that participating in volunteer activities with the Foundation involves certain foreseen and unforeseen hazards and risks. I am voluntarily participating in the volunteer activities and services, and I accept all risks of such participation.

•       I understand that that Foundation is not responsible for any bodily injury, illness or property damage arising out of or connected to my volunteer activities, including any claims based on negligence. I agree to indemnify and hold harmless the Foundation for all claims, whether in law or equity, arising out of my participation in volunteer activities. I agree to release, waive, discharge and not to sue or assert any claim against the Foundation or its officers, agents, employees, volunteers, or affiliates from any and all liability, claims, demands, actions and causes of action of any kind or nature, damages, judgments and expenses, including attorneys’ fees and costs, that arise out of or are in any way related to any loss, damage, illness or injury that I or my property may sustain in connection with participation in volunteer activities wherever, whenever, or however the same may occur.

•       If I am injured while participating in volunteer activities, I understand that I will be liable for all damages and medical costs related to such injuries and that the Foundation will have no liability for the same.

•       I have been informed of any volunteer activities that will involve excessive walking, heavy lifting, sitting, and/or other activities that could pose a risk to my health or safety while volunteering. Should I be injured prior to volunteering with the Foundation, I will inform the Volunteer Relations Coordinator.

 

Promotional Release – I understand that I may be photographed or recorded during my volunteer activities for promotional use by the Foundation. I hereby grant to the Foundation all right, title and interest in any photographs, images, video or audio recordings of me made in connection with my volunteer activities.

 

I agree that this Release is intended to be as broad and inclusive as permitted by the State of Nevada, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Nevada. I agree that if any part of this Release is deemed to be invalid, the remainder of this Release shall continue in full force and effect.

Volunteers are encouraged to connect with the LVMPD Foundation via social media and support our programs, promotions, and messaging. However, it is important to understand that the use of social media can pose risks to the LVMPD Foundation's confidential information, reputation, and brand, and can expose the LVMPD Foundation to potential legal risks. 

In order to protect our relationships, as well as maintain the confidentiality of our families, sponsors, donors, entertainment and sports figures/entities, and volunteers, the following guidelines must be adhered to when posting about LVMPD Foundation via social media including but not limited to: Facebook, Twitter, LinkedIn, Instagram, Pinterest, YouTube, and Snapchat.

General Posting Expectations

• As a LVMPD Foundation volunteer, your actions, words, and behaviors represent not only you as an individual, but LVMPD as well. While the Foundation respects your right to post personal comments and perspectives on social media sites, posting about topics that are inconsistent with our values (LVMPD, integrity, impact, and community) may be misconstrued as representing the views of the LVMPD Foundation. Please keep in mind how or what you post and the impact it may have on LVMPD and our Foundation. 
• Individuals must refrain from sharing identifying information regarding our donors, volunteers, or staff members of any sort or confidential information that was communicated as part of their role at the LVMPD Foundation events, including personal details about officers and their families.
