I have voluntarily applied to The Foodbank of Southern California (“The Foodbank”) to participate in volunteer and other related activities (Volunteer Activities”), including any activities incidental to such participation at The Foodbank and other various locations.
In participating in The Foodbank Volunteer Activities and all related activities, the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) releases The Foodbank or its officers, directors, employees, sub-contractors, sponsors, agents and affiliates (“Released Entities”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur.
I understand and agree that The Foodbank is not responsible for any injury or property damage arising out of the Volunteer Activities, even if caused by their ordinary negligence or otherwise.
I understand that participation in the Volunteer Activities involves certain risks, including, but not limited to, serious injury. I am voluntarily participating in the Volunteer Activities with knowledge of the danger involved and I agree to accept all risks of participation.
I also agree to indemnify and hold harmless The Foodbank for all claims arising out of my participation in the Volunteer Activities.
I understand that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California. I understand that I may later discover claims, facts, actions, losses or damages and it is my intention to fully and completely waive and release The Foodbank and the Released Entities from all such unknown matters and claims. This Release shall be governed by and interpreted in accordance with the laws of the State of California. If any clause in this Release is made invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
I also acknowledge that The Foodbank and the Released Entities do not carry or maintain health, disability or accident insurance coverage for any volunteer. I release and forever discharge The Foodbank and the Released Entities from any action, claim or demand whatsoever which arises or may hereafter arise on account of any first aid or medical treatment rendered to me. I understand that each volunteer is expected to have adequate health insurance coverage in effect at all times while participating in Volunteer Activities. I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Volunteer Activities.
I HAVE CAREFULLY READ THIS ASSUMPTION OF RISK AND RELEASE AGREEMENT AND I FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN ME AND THE FOODBANK. I AM SIGNING THIS RELEASE OF MY OWN FREE WILL.
