I am an adult over the age of eighteen (18), in consideration of being permitted to perform volunteer services for City of Merced (“City”), agree as follows:

 

1. The Undersigned hereby releases, waives, discharges and covenants not to sue the City of Merced, its employees, officers and agents (hereafter the “Releasee”) from all liability to the Undersigned, its representatives and assigns for any loss, damage or claim therefore on account of injury to the person or property of the Minor Volunteer whether caused by the ordinary negligence, act or omission of the Releasee, or otherwise, while the Minor Volunteer is volunteering for the City or using City facilities or equipment in connection with his/her volunteer services.

 

2. The Undersigned hereby agrees to indemnify and hold harmless the Releasee from all liability, claims, demands, causes of action, charges, expenses, and attorney fees resulting from the Minor Volunteer’s volunteer services, whether caused by any act or omission of ordinary negligence of Releasee, or otherwise.

 

3. The Undersigned understands and agrees that I shall not be deemed to be an employee of the City for any reason and shall not be entitled to any employee benefits, except for workers’ compensation benefits in the event that I sustain an injury arising out of and in the course of any volunteer work that I perform for the City pursuant to City Resolution No. 81-1.

 

4. The Undersigned hereby grants to the City of Merced and their legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of me for advertising and any other promotional purposes and in any manner and medium; to alter the same without restriction; and to copyright the same. I hereby release the City of Merced and their legal representatives and assigns from all claims and liability relating to said photographs.
The Undersigned expressly agrees that the foregoing release and waiver and indemnity agreement are intended to be as broad and inclusive as permitted by California law.

 

I hereby certify I have never been arrested for or convicted of any felony or misdemeanor involving sexual or physical abuse of any adult or child, or any felony narcotics offense. I authorize the City of Merced to obtain my criminal records and understand that the fact that I am requesting to volunteer will be reported to law enforcement agencies. All statements and information submitted on this agreement are true and correct.
